Privacy Policy
Himawari Education Co., Ltd. (hereinafter referred to as “the Company”) establishes the following Privacy Policy (hereinafter referred to as “this Policy”) regarding the handling of users’ personal information in connection with the services provided on this website (hereinafter referred to as “the Services”).
Article 1 (Personal Information)
“Personal Information” refers to “personal information” as defined in the Act on the Protection of Personal Information, and means information relating to a living individual that can identify a specific individual by name, date of birth, address, telephone number, contact details, or other descriptions contained in such information, as well as data relating to appearance, fingerprints, voiceprints, and information that can identify a specific individual by itself, such as the insurer number on a health insurance card (personal identification information).
Article 2 (Methods of Collecting Personal Information)
The Company may ask users for personal information such as name, date of birth, address, telephone number, email address, and driver’s license number when they register to use the Services.
In addition, the Company may collect records of transactions and payment information containing users’ personal information made between users and the Company’s business partners from the Company’s business partners (including information providers, advertisers, and advertising distributors; hereinafter referred to as “Business Partners”).
Article 3 (Purpose of Collecting and Using Personal Information)
The purposes for which the Company collects and uses personal information are as follows:
- To provide and operate the Company’s services
- To respond to inquiries from users, including verifying their identity
- To send emails regarding new features, updates, campaigns, and other services provided by the Company related to the services currently used by the user
- To contact users as necessary regarding maintenance, important notices, and other matters
- To identify users who violate the Terms of Use or who attempt to use the services for fraudulent or improper purposes, and to refuse their use of the services
- To allow users to view, change, or delete their registered information, and to view their usage status
- To bill users for paid services
- For purposes incidental to the above purposes of use
Article 4 (Changes to the Purpose of Use)
The Company may change the purpose of use of personal information only when the changed purpose is reasonably considered to be related to the original purpose.
If the purpose of use is changed, the Company shall notify users of the changed purpose by the method prescribed by the Company, or publish it on this website.
Article 5 (Provision of Personal Information to Third Parties)
The Company will not provide personal information to any third party without obtaining the user’s prior consent, except in the following cases or where permitted by the Act on the Protection of Personal Information or other applicable laws and regulations:
- When it is necessary to protect a person’s life, body, or property, and it is difficult to obtain the individual’s consent
- When it is especially necessary for improving public health or promoting the sound growth of children, and it is difficult to obtain the individual’s consent
- When it is necessary to cooperate with a national government agency, a local government, or a person entrusted by either in performing duties prescribed by laws and regulations, and obtaining the individual’s consent may interfere with the performance of such duties
- When the following matters have been announced or published in advance, and the Company has submitted a notification to the Personal Information Protection Commission:
- The purpose of use includes provision to third parties
- The items of data to be provided to third parties
- The means or method of provision to third parties
- That provision of personal information to third parties will be stopped at the request of the individual
- The method for accepting such requests from the individual
Notwithstanding the preceding paragraph, the recipient of such information shall not be considered a third party in the following cases:
- When the Company outsources all or part of the handling of personal information within the scope necessary to achieve the purpose of use
- When personal information is provided in connection with the succession of business due to a merger or other reason
- When personal information is jointly used with a specific party, provided that the individual is notified in advance, or the information is made readily available to the individual, regarding:
- the fact that personal information will be jointly used,
- the items of personal information to be jointly used,
- the scope of parties jointly using the information,
- the purpose of use by those parties, and
- the name of the person or entity responsible for managing the personal information
Article 6 (Disclosure of Personal Information)
When the Company is requested by an individual to disclose their personal information, the Company shall disclose it to the individual without delay. However, if disclosure would fall under any of the following cases, the Company may decide not to disclose all or part of the information, and if such a decision is made, the Company shall notify the individual without delay.
A handling fee of JPY 1,000 will be charged for each request for disclosure.
- When disclosure is likely to harm the life, body, property, or other rights or interests of the individual or a third party
- When disclosure is likely to seriously interfere with the proper conduct of the Company’s business
- When disclosure would otherwise violate laws or regulations
Notwithstanding the preceding paragraph, in principle, information other than personal information, such as history information and characteristic information, will not be disclosed.
Article 7 (Correction and Deletion of Personal Information)
If a user’s personal information held by the Company is incorrect, the user may request that the Company correct, add to, or delete the personal information (hereinafter referred to as “Corrections, etc.”) in accordance with the procedures prescribed by the Company.
If the Company determines that it is necessary to respond to such request from the user, the Company shall make the relevant Corrections, etc. without delay.
If the Company makes such Corrections, etc. based on the preceding paragraph, or decides not to make such Corrections, etc., the Company shall notify the user without delay.
Article 8 (Suspension of Use of Personal Information, etc.)
If the Company is requested by an individual to suspend the use of or erase their personal information (hereinafter referred to as “Suspension of Use, etc.”) on the grounds that the personal information is being handled beyond the scope of the intended purpose of use or was obtained by improper means, the Company shall conduct the necessary investigation without delay.
Based on the results of the investigation described in the preceding paragraph, if the Company determines that it is necessary to respond to the request, the Company shall carry out the Suspension of Use, etc. of the relevant personal information without delay.
If the Company carries out the Suspension of Use, etc. based on the preceding paragraph, or decides not to carry out the Suspension of Use, etc., the Company shall notify the user without delay.
Notwithstanding the preceding two paragraphs, where the Suspension of Use, etc. would involve substantial cost or would otherwise be difficult to implement, and alternative measures necessary to protect the rights and interests of the user can be taken, the Company shall take such alternative measures.
Article 9 (Changes to the Privacy Policy)
The contents of this Policy may be changed without notice to users, except as otherwise provided by laws and regulations or otherwise specified in this Policy.
Unless otherwise specified by the Company, the revised Privacy Policy shall become effective when posted on this website.
